Football hooligans free to cross border after legal loophole is revealed - 14/11/2010
LAWS barring English football casuals from Scots grounds are in chaos after three yobs used a legal loophole to beat a charge.
Prosecutors ditched a case against Colin Hamblett, 48, his son Damien, 24, and David Ainsworth, 49, after their lawyer said football banning orders imposed on them in England did not apply in Scotland.
It means Scotland is the only country where Colin Hamblett can attend top-level games.
His ban applies in England and Wales and he has had his passport seized to stop him causing trouble abroad.
Experts believe banning orders handed to Rangers hooligans after the 2008 UEFA Cup final riot in Manchester could also be worthless in the wake of the Hamblett case.
The Hambletts and Ainsworth were arrested in July after travelling to Scotland to watch their team, Bolton Wanderers, play Falkirk in a pre-season friendly.
English cops had tipped off Central Scotland Police that the men planned to travel.
All three were given three-year banning orders in January 2009 after they were fined for being drunk and disorderly at Bolton's Boxing Day game against Liverpool at Anfield.
Ainsworth was also arrested for hurling racial abuse.
The Central Scotland cops accused the men of breaching their banning orders.
They were due to stand trial at Falkirk Sheriff Court last week but the case was dropped at the last minute.
Defence lawyer Gordon Addison said yesterday: "We argued there were difficulties in enforcement of an order of an English judge in a Scottish court and this was accepted by the Crown."
Football law expert GeoffPearson, of the University of Liverpool , warned that the case could have serious implications.
He said : "In future, every banning order will have to be examined in detail to ensure they can be applied equally in Scotland, England and Wales.
"It could involve a change in the law.
"In the meantime, the Home Office will have to write to all the courts in England to make sure they are aware that banning orders must be made separately for Scotland."
Leading Scots QC Paul McBride says the loophole could mean hooligans travelling between Scotland and England.
He said: "It doesn't take much to get a train to Newcastle or Manchester on the morning of the game. Scottish hooligans will do that."
Colin Hamblett, who runs the Brindley Arms pub in Manchester, said he was "delighted" the Scots case had been dropped.
He claimed: "I'm not a bigtime football hooligan, though I know people who are.
"I've been arrested in the past, but mainly for getting drunk at games. The incident in Liverpool is my only conviction."
Hamblett said he was also a Rangers fan who travels to Scotland twice a year for games.
Asked if there was much trouble at his pub, he replied:"We police it ourselves."
How the thugs team up
Scots cops have been alarmed by alliances between English and Scottish casual gangs.
Last year, around 40 Hibs casuals rioted in Bolton during a pre-season match. And in 2008, five Dundee fans were banned from all UK grounds after organising a street brawl with Millwall fans.
The infamous Chelsea headhunters gang were accused of starting trouble at Pittodrie in 2002 when Aberdeen played Rangers.

Football hooligans in York 'face tough action' - 13/11/2010
Football hooligans intent on causing trouble in York before a forthcoming replay will be dealt with robustly, police in North Yorkshire have said.
The warning of tough action comes a week after trouble in the run-up to York City's FA Cup first round game against Rotherham United.
Officers said a minority of York fans caused trouble en-route to South Yorkshire for the game on 6 November.
Police said they would "come down hard" on any trouble in York on Wednesday.
Ch Insp Dave Hannan said: "Wednesday night is a big game for York City and the club's fans and I am hoping that the minority of people who seem intent on using football as an excuse to cause trouble don't spoil it for the genuine supporters. Banning orders
"We are aware of the disorder which occurred last Saturday and we will not tolerate a repeat on Wednesday night.
"Our officers are ready to deal with any trouble and we will come down hard on any people causing disruption in the city."
Police said they were taking football-related disorder seriously and had the power to impose football banning orders on people who cause trouble at matches.
Ch Insp Hannan added: "We can and will seek to impose banning orders on individuals responsible for football-related disorder."

Bellamy bust-up: Fan arrested after punch thrown at Cardiff striker
Wales striker Craig Bellamy was involved in an incident during the early stages of Scunthorpe's game against Cardiff City yesterday that led to a fan being arrested and held in custody. Shortly after Cardiff had established a two-goal lead they won a corner and, as Bellamy went to take it, a fan climbed over a perimeter hoarding and appeared to throw a punch at the player. Bellamy, who did not react, drew referee Eddie Ilderton's attention to the matter and the fan was taken away. Bellamy then involved himself in a verbal confrontation with a number of fans before eventually taking the corner kick a good two minutes later. Bellamy said: 'The man should not have been on the pitch. I wouldn't have said he threw a punch but it was a stupid situation, he should never have been there, and I was angry because the stewards didn't seem to do anything about it.' His manager, David Jones, pulled up short of criticising Scunthorpe or the stewards, however, but said: 'It could have been an ugly situation and Craig could have got himself into trouble because of it. 'It's not always easy to turn the other cheek when fans are hurling abuse at you and, whoever the culprit is, he should be banned for life. I thought he had thrown a punch, which is totally unacceptable, and the authorities have to take stern action to prevent incidents like this.'

Zenit fans rampage after winning Russian title
Hundreds of Zenit St Petersburg supporters clashed overnight with riot police and smashed bus stops in the centre of Russia's second city after their team won the domestic league.
Fans invaded the pitch and tore down the goalposts after Zenit crushed Rostov 5-0 on Sunday to secure the title and qualify for the group stages of next season's Champions League.
At least 1,000 Zenit supporters -- who have one of the worst reputations for violence in Russia -- then tried to march down the city's main thoroughfare Nevsky Prospekt but were blocked by riot police, Reuters witnesses said.
State television showed pictures of several dozen riot police, backed by two armoured cars, running towards fans.
Reuters witnesses saw police beat and detain several fans who threw flares and bottles.
A spokesman said police prevented around 200 fans from marching down the city's main street but denied there were clashes.
He added one policeman suffered a minor head injury after falling.
Last month Russian news agencies reported that several fans from Croatian club Hajduk Split were beaten up by Zenit rivals at a hotel in St Petersburg ahead of a Europa League game.

Boro in plea to fans after trouble at Riverside revealed - 16/11/2010
Source : Gazettelive.co.uk
BORO today issued a plea to some fans to behave after revealing a rise in trouble and vandalism at the Riverside.
With the appeal comes shocking evidence of how some supporters are putting the boot into their own club by vandalising the stadium and trying to attack opposing fans.
And the club warns that if things don’t improve, it may have to close the south-east corner - base of the Red Faction fans’ group and where much of the trouble seems to stem from.
Boro say the Football Association, Cleveland Police and Middlesbrough Council have all stressed “the gravity of the situation the club may face if the problems continue.”
Incidents have included Boro fans forcing open south stand concourse doors to get at Leeds fans, sparking clashes.
After the Crystal Palace game, a steward suffered a head injury and police had to be called after Boro fans tried to rip down a fence around visiting fans’ travel coaches.
And Boro say 34 seats in home areas have been damaged, as well as concourse damage, “after home fans turned on their own stadium.”
Today, Boro chief executive Keith Lamb said the actions of a minority were causing major problems for the club.
He said: “The club is fully behind the need for enthusiastic and vocal support, and we recognise the efforts of many fans, particularly in the south-east corner, to maintain a good match atmosphere.
“The police, safety advisory group and club safety officials are, however, growing increasingly concerned about the problems in the south-east corner, which include violent disorder, stadium damage, the inciting of problems with rival fans, insistence on standing throughout every game and refusal to adhere to policies over banners and flags.
“The cost of stadium repairs are already substantial, while a further outcome of all these problems may be an increased level of policing and substantial associated costs being forced upon us. I am sure supporters will understand every penny we spend on these issues is a penny less to invest in our playing aspirations.”
The club claims several founding members of Red Faction have left the group, “claiming the group’s main driving force was to be a non-conformist, anti-club movement.”
One former member told the Gazette today: “The original reason the group was set up was passionate fans - fans, not hooligans - wanting to re-energise the stadium.
“But it now seems to be moving away from that - more Red Friction than Red Faction.
“It’s fans who’ll have to pay for the seats, plus the extra stewarding and policing bills.”
He said the group now contained lots of youngsters “who were being manipulated into breaking rule after rule by individuals who wanted to have no interface with Boro.”
He added: “We were being encouraged to avoid speaking to the club and create havoc like foreign ‘Ultra’ fans do.”
Mr Lamb said the club has to comply with its safety certificate or Middlesbrough Council’s safety advisory group can impose sanctions, such as restricting away fan numbers.
He stressed: “It would be disappointing if we were forced to close any part of the stadium, as this would mean many fans being inconvenienced due to the actions of what I am certain are a small minority of individuals.
“We would therefore appeal to all supporters and fan groups to work with the club to ensure the Riverside remains a safe place for all fans to enjoy what we hope will be increasingly more enjoyable football.”
John Donovan, of fans group The Twe12th Man, said: “We have always found the club to be willing to enter into dialogue and offer help to resolve any problems.”
Chief Insp Gary Stephenson, of Cleveland Police, said: “Cleveland Police and the safety advisory group have always worked closely with the club to resolve any matters in relation to the safety of spectators and other matters relating to the fixtures and will continue to do so.”

Italy striker Mario Balotelli suffers racist abuse from Italian fans during friendly
Italy coach Cesare Prandelli was disgusted at the racist chants hurled at Mario Balotelli in Wednesday's 1-1 friendly against Romania in Austria. The Manchester City striker, who was born in Italy but is of Ghanian descent, was booed every time he touched the ball, with the taunts coming from a group of about 100 extreme right-wing Italian fans at the match at Klagenfurt's HYPO Group Arena. 'I feel disappointment and anger,' said Prandelli. 'We always hear these chants and something has to be done about it. 'We feel helpless. He has the support of everyone.' It's not the first time Balotelli has suffered racist abuse. While at Inter Milan, the player was subjected to racist chants by rival fans. Balotelli, who has been linked with a return to Italy and AC Milan, played for an hour against Romania before being substituted. The 20-year-old was denied on several occasions by Romania goalkeeper Costel Pantilimon. 'His performance was optimum,' said Prandelli. 'He has done really well. It's a pity in the first half we didn't have much depth.'

Police commended for bravery in violence at Portsmouth FA Cup tie - 19/11/2010
Source : dailyecho.co.uk
FIVE Southampton supporters accused of being part of ugly scenes after the fifth round FA Cup tie with arch rivals Portsmouth have all been dramatically cleared.
Jurors found the final three defendants not guilty of violent disorder after charges against two other men were dropped during the trial.
After the verdicts, Judge Gary Burrell QC took the rare step of asking a sixth defendant, Peter Smithson, 36, whether he wanted to change his plea.
The self-employed electrician, pictured right, of Adams Close, Hedge End, had pleaded guilty to violent disorder at the start of the 13-day trial but yesterday admitted the lesser charge of affray.
He received a 51-week suspended prison sentence, with 80 hours’ unpaid work. He was also banned from attending football matches in Engl-and and Wales for three years and must not go within a mile of St Mary’s Stadium four hours before and four hours after a game.
The court heard how Smithson – who was of previous good character – had shaken temporary fencing in Britannia Road, put up to keep fans apart, two or three times with an “aggressive look”. But when shown police footage of his behaviour, he was “horrified” and remorseful. The judge remarked: “What got into your head, I don’t know. There were quite a lot of decent, professionals like you who seemed to have lost it – something which the courts will not tolerate.”
The defendants were charged with violent disorder followed the violence outside the Freeborn garage in Britannia Road. Missiles including coins, bricks and stones were hurled before police reinforcements, including officers on horseback, restored order.
Two defendants, Michael Wilson, 28, of New Road, Netley Abbey, and Timothy Osman, 49, of Cunard Avenue, Shirley, were cleared midway through the case.
The jury of eight men and four women then cleared Ross Phillips, 28, of Swift Road, Southampton; Martyn Bishop, 43, of Wheatlands, Fareham, and Trevor Collins, 46, of Meggeson Avenue, Townhill Park, Southamp-ton. All in turn thanked the jury.
At the end of the hearing, the judge commended the police for the way they had defused the trouble. He said: “It was extremely frightening for those there, particularly the thin blue line holding the line until they got reinforcements. They did that with bravery and professionalism.”

Aston Villa v Birmingham City derby: Police issue images of thugs - 18/11/2010
POLICE hunting soccer thugs involved in ugly scenes of violence after the second city derby today released images of men they want to trace.
Rival fans clashed outside Villa park after the final whistle of the 0-0 draw between Aston Villa and Birmingham City on October 31.
A total of seven people were arrested on the day.
But after scouring video footage of the skirmish, officers from West Midlands Police Football Unit have issued images of nine men and called on Birmingham Mail readers to name them.
During the violent scenes in outside Aston Hall, in Witton Lane, a number of police officers were injured as they came under a barrage of missiles thrown from the mob.
One officer narrowly avoided losing the sight in one eye after being hit on the cheek by a coin.
Police want to question the men on suspicion of violent disorder.
Two of the men are believed to be Blues fans and the remaining seven are thought to be linked to Aston Villa.
The images were taken from police surveillance footage. In one of the images, a man can be seen giving a ‘thumb’s up’ sign to the camera.
Pc Colin Barlow, from the Force Football Unit, said: “I would urge people who recognise themselves to make contact with police and ask readers who can identify them to come forward.
“The two sets of fans clashed as they made their way from the ground which led to spontaneous disorder.
“Missiles were thrown and a number of people were assaulted. This continued for about half an hour. Several police officers were injured.” A number of troublemakers have already been identified by police.
Pc Barlow said this was the first phase of the operation, codenamed Gridiron, to identify all those involved in the trouble.
And police pledged there would be further arrests.
They said they would seek Football Banning Orders against anyone convicted of taking part in the violence to have them banned from attending games both home and away.
Earlier this month, 11 Blues fans were hit with three year banning orders and handed suspended jail sentences after being convicted to taking part in trouble that followed the derby game at St Andrew’s in September last year.
The crackdown on troublemakers comes less than two weeks before the two sides meet again in what is expected to be a crunch clash in the quarter finals of the Carling Cup.

'it's time you all grew up' - 20/11/2010
Source : thisissouthwales.co.uk
HOOLIGANS who confronted police at a derby day clash between Swansea and Cardiff football clubs have been told: "All of you have to grow up — whatever your age".
The message from Judge John Diehl came after 12 men came before him for sentencing following an incident of violent disorder outside the Liberty Stadium after the Swans beat their biggest rivals on November 7 last year.
Two men were jailed for their parts in the disturbance, and others told they had missed a custodial term "by a whisker".
Before handing out their punishments, Judge Diehl told them: "It seems to be a sad fact of life that fixtures between Swansea City and Cardiff City pose a continued flash point for violence.
"One of the officers who gave evidence to me spoke effectively of the atmosphere being venomous. The potential for conflict seems to be almost tribal in its depth, and completely irrational.
"Police have to take extraordinary measures to keep the peace in collaboration with the club to protect away fans and coaches to the extent they shut roads to traffic."
He added: "All of you have to grow up, whatever your age."
Eleven men had admitted using or threatening unlawful violence.
Lee Howells, 31, of Baptist Well Street, Waun Wen, was jailed for a total of two years and nine months, minus 203 days already spent in custody, for offences which also included handling stolen goods, criminal damage and possession of cannabis.
Kevin Richards, 24, of Evans Road, Neath, was sentenced to three years and three months, for offences which also included having an offence weapon.
Liam Lewis, 20, formerly of Tawe Avenue, Hafod, but now of Mumbles; Thomas Lewis, 20, of Townhill Road, Townhill; Sam Smith, 19, of Gwynedd Gardens, Townhill; Steven Lewis, 47, of Llangyfelach Road; Sean Rees, 38, of Brondeg Crescent, Manselton; Liam Arrigan, 22, of Bartley Terrace, Plasmarl; Remi Whitelock, 19, of Adare Street, Port Talbot; Stuart Jones, 19, of Pendre, Litchard, Bridgend; Joshua Sprake, 19, of Stepney Road, Burry Port; Lee Peter Davies, 24, of Ravenhill Road, Fforestfach, were all given sentences of 52 weeks, suspended for 18 months, and given curfews and ordered to be tagged.
Joshua Barnes, 18, of Fforest Hill, Aberdulais, was given a community punishment and rehabilitation order for 18 months.
